Mewsnet New Zealand Terms of Service

On your use of Mewsnet New Zealand, all users are expected to read this Terms of Service and to agree with the content.

<Terms of Service>

I. Definition

Mewsnet New Zealand Terms of Service ("these Terms") establishes the relationship between the users of the Social Networking Service Mewsnet New Zealand ("this service") and WIZCOPE. These Terms apply to any relationships connected with using this service. The member will be considered to have agreed with these terms once the membership registration has been completed. Without the agreement, this service cannot be used.

II. Self responsibility

Members are to use this service with self responsibility and to fulfil their obligation to heed the followings. Any losses or damage caused by the violation of the Terms or others is not to be responsible to WIZCOPE.
1. Members need to save their own texts made by themselves or other data with their own responsibility.
2. Members need to supervise their own password for this service so as not to be known by the third parties.
3. Members must not infringe upon copyright, the rights to one's portrait(s), privacy or any other rights other users, the third parties or WIZCOPE possess.

III. Supervision of Data

Members are to consent to the uncertainty of consistency and saving data and files. WIZCOPE is not responsible for any loss of data or file stored or saved while using the service.

IV. Particulars Prohibited

This service prohibits the following acts.

1. To violate laws or to invite or promote illegal acts
2. To interfere with other users' access or operations
3. To interfere our site management or network systems
4. Defamation, infringement upon others' confidence, privacy, publicity, copyright or any other rights
5. Calumny, intimidation, harassment or any other actions financially or mentally detrimental to other users
6. To post expression or description that might lead to ethnical, racial, sexual, age or other discrimination
7. To post porn, nudes, obscene or violent images, or any other images, words or other expressions that might make other users feel unpleasant
8. To alter or erase information, or to transmit or post false information
9. To transmit (send) by means of message function and so on or to post contents for commercial advertisement, publicity or solicitation
10. To name somebody else, to name organisations such as companies without any rights for representation or proxy, or to feign affiliating with other person or organisations
11. To collect or store other users' personal information
12. To copy, duplicate, upload, post, transmit or distribute records regarding this service
13. Other acts against common sense, public order and standards of decency WIZCOPE judge to be inappropriate

In the case the acts above are found, we take appropriate disposal including altering posted information, erasing registration, or claiming indemnity.

V. Handling members' information

WIZCOPE handles personal information esteeming users' privacy at this service and follows its Privacy Policy.

VI. Changes on the Terms

WIZCOPE can change the Term without its users' agreement. In this case, the modified Terms will be active from the time it has been indicated on the site.

VII. Immunity from responsibility

WIZCOPE is not responsible for any losses occurred against its members. Also, WIZCOPE have no responsibility for any loss its member has caused by the third party, and the member who caused any loss on the third party should compensate and solve the problem, and never to cause any loss of WIZCOPE.

VIII. Suspension and closure of the service

In the case WIZCOPE has judged that any of the followings applies, it may suspend the service temporary without any notice for the purpose of providing the service in good condition all the time.
1. In the case of regular or urgent maintenance
2. In the case the load has been concentrated on the system
3. In the case WIZCOPE has judged there would be a hindrance on management of the service
4. In the case it is needed to secure members' security
5. In the case it is impossible to provide the service because of fire, blackout, and so on
6. In the case it is impossible to provide the service because of earthquake, eruption, flood, tsunami or any other natural disasters
7. In the case it is impossible to provide the service because of war, riot, labor dispute or others
8. In any other cases WIZCOPE judge the temporal suspension of the service is needed on management or technical perspective

In addition, the service may be partly or entirely closed on WIZCOPE's judgement and the date and time of the closure would be notified to the members.

IX. Relevant court and the law in accordance

The description of the Term accords with the law of New Zealand, and in the case a law case between WIZCOPE and its user has occurred and need to be filed, the relevant court of the city WIZCOPE is located will be the relevant court with an exclusive agreement for the first-instance trial.
